MARRIAGE

The standard definition of marriage is “The voluntary union for life of one man and one woman to the exclusion of all others”. (Hyde v. hyde (1866)).

In this country marriage is monogamous, which means, as the definition above indicates, one man and one woman. The gender is fixed at birth, and the birth registration is an historical record. In R. v. registrar General of England and Wales (1996), the court held that the birth certificate cannot be changed for persons who have undertaken surgery for a sex change. When a party is allowed to have more than one spouse at the same time, it is polygamy. In certain countries polygamy is allowed.

Before looking further into the definition, with all the obligations and legal duties which marriage brings upon the parties, it is helpful to consider the legal consequences of the preliminaries that may lead to marriage, such as engagement and co-habitation.

1-    Engagement

There is now no action for “breach of promise”. Until the Law Reform (Miscellaneous provisions) Act 1970 abolished this right of action, a party (usually the woman) could sue for damages for breach of contract if the other party refused to marry.

Engagements are usually formalized by the man giving the woman an “engagement” ring. The ring remains the property of the woman should the engagement be broken, unless at the time it was given at the man made it clear that in the event of the marriage not taking place the ring was to be returned. In Mossop v. mossop (1988), where an engaged couple cohabited for five years but never married, it was held that engaged couples do not have the same rights as married couples to claim under legislation specifically provided for married couples.

2-    Cohabitation

The legal status of an unmarried couple living together as man and wife is very complex, as the law does not recognize such a “marriage”. Parliament has recognized, however, that in certain matters these partners duties and problems as legally married partners and has provided appropriate legislation.

For example a woman may claim against the estate of her deceased partner as a dependent.

 

The Requirements of a Valid Marriage

 

1-    Both parties must be 16 years of age or over

If either under 18, consent must be given by both parents, if alive. If the parents refuse to give permission, the minor may apply to the magistrates’ court where the magistrates’ will make a decision based on what they consider to be in the best interests of the minor. A marriage which is formally solemnized without this permission will be valid. A marriage where one of the parties is under 16 years is void.

2-    The Prohibited Degrees

The parties must not be closely related, as marriage is not allowed between parties within the prohibited degrees. This means that certain persons who are closely related, either by blood or marriage, may not marry each other. The obvious relations that are not allowed to marry are parents to their children (e.g. father and daughter, mother and son) and brothers and sisters. The Marriage Act 1949 as amended by the marriage (Enabling) Act 1960, provides two complete lists of the prohibited degrees; a list showing the relations a woman may not marry, and a list of relations a man may not marry. Generally, uncles may not marry nieces, nor aunts their nephews’, but first cousins may wed, and a woman may marry her husband’s brother, uncle or nephew if her marriage has ended by death or divorce. A man has a similar right to marry his former wife’s sister, niece or aunt. The marriage (Prohibited Degrees of Relationship) Act 1986, makes further provision for the marriage of persons related by infinity (or marriage). For example, a man could now marry a woman who is the daughter of a former spouse of his (and who is obviously not his daughter), provided that they are both 21 or over and the younger party had not been a child of his family at any time before attaining the age of 18.

The reason for these prohibitions is, first, public policy, and, secondly, the genetic risk which might produce undesirable side effects or characteristics in a child born of a marriage between blood relatives.

3-    Neither party must be in an Existing Marriage

A person who marries for a second time whilst the first marriage is in existence may commit the crime of bigamy, although the following defences may be pleaded:

(a)               That in good faith and on reasonable grounds, it was believed the spouse was dead.

(b)     That in good faith and on reasonable grounds, it was believed that the first marriage was annulled or dissolved.

(c)                That the first spouse had been missing continuously for seven years, and there was no reason for supposing that partner to be alive.

4-    The Formalities required by statute

A marriage ceremony must be performed and solemnized as provided by the Marriage Acts 1949 and 1983.

Void and Voidable Marriage

A void marriage means that, as far as the law is concerned, no marriage has existed and the parties are in a single state. On the other hand, a voidable marriage is regarded as legally valid until a court of competent jurisdiction pronounces it a nullity. Marriages are void because of some defect which is so fundamental that it is considered the marriage never existed.

Voidable marriages are valid, but, because of certain circumstances after, or at the time of the wedding, they may be annulled by the courts:

1-    Void Marriage

The nullity of Marriage Act 1971, as now consolidated in the Matrimonial Causes Act 1973, provides that marriages shall be void for the reason that a valid marriage had not taken place because:

(a) One or both of the parties___

(i)      Were under 16 years old

(ii)     Were within the prohibited degrees

(iii)    Were already married

(iv)    Had entered a polygamous marriage whilst being domiciled in England or wales

(b) There was a basic defect in the marriage ceremony.

(c) The parties were not respectively male or female.

 

2-    Voidable Marriage

Section 2 of the nullity of marriage Act 1971, as consolidated in the Matrimonial causes Act 1973, provides that marriages are voidable for the following reasons:

(a)     The marriage had not been consummated, owing to incapacity or the willful refusal to consummate, by either party. This means that one party was incapable of having sexual intercourse or refused to do so.

(b)     Either party did not validly consent to the marriage because of duress, mistake, unsoundness of mind or otherwise. Parties to marriage must give their consent because he does not know the consequences of what he is saying. This situation may also exist if one of the parties is drunk or under the influence of drugs.

(c)     Either party was, at the time of the marriage, suffering from a mental disorder within the mental health Act 1983, which makes them unfitted for marriage.

(d)     One party was suffering from venereal disease in a communicable from and the other party did not know.

(e)     At the time of the marriage, the man did not know that the bride was pregnant by some person other than him.

A petition for nullity of a marriage may be made to the court immediately. There is no need, as with divorce, to wait for a period of time. Petitions for reasons (c), (d) and (e) above, must be made within three years but this period may be extended if the petitioner has been suffering from a mental disorder. The court has the discretion to refuse to grant a decree if it considers it would be unjust to do so.

It must be noted that children born of a voidable marriage are legitimate, even if the marriage is later declared void by the court, and children born of a void marriage are legitimate, if, at the time of conception (or the marriage, if later), the parties reasonably believed the marriage to be valid.

 

The Formalities of a Marriage

A marriage may be solemnized by a Church of England ceremony, by ceremonies of another religion or in a registrar’s office. The formalities of each ceremony are different.

1-    Church of England

(a)     Banns have to be published. Banns are a public announcement that the marriage is to take place and they must be published on three Sundays in the churches of either or both of the parties.

(b)     A common license has to be issued  by a bishop for the marriage to take place within the parish of one of the parties, or the Archbishop of Canterbury has to issue a special license which permits the parties to marry anywhere.

(c)     A superintendent registrar’s certificate has to be issued, which authorizes the church to solemnize the marriage.

(d)     The wedding must take place between the hours of 8 A.M. and 6 P.M. within three months of the banns being published, and there must be two or more witnesses.

2-    Marriages Solemnized by a Superintendent Registrar’s Certificate

The certificate authorizes a marriage to take place:

(a)     In the superintendent registrar’s office, or

(b)     In a registered building (usually a church of a non-Anglican religion) except in marriages between two professing Jews or between members of the society of Friends (Quakers),

(c)     Between the hours of 8 A.M. and 6 P.M. before open doors and witnessed by at least two persons (except Jewish or Quaker marriages).

(d)     Within three months of the issue of the certificate.

(e)     The Marriage Act 1983 enables marriages of house-bound and detained persons to be solemnized at the place where they reside.

3-    The Marriage Act 1994 enables Civil marriages to take place on “Approved Premises”.

Premises will be approved by the local authority, and must have provision for members of the public to attend. The marriage must have two witnesses, a superintendent registrar and a registrar of the registration district in which the premises are situated. A religious service may not be used.

The aim of the Act, which came into force on April 1, 1995, is to maintain the sanctity of marriage and the ceremony may be held in a fixed building, in a dignified setting, in a specified room or area of the premises licensed by the local authority.

The change has resulted in many applications from a variety of “buildings” including football clubs, The Royal Pavilion at Brighton, Blackpoll Tower and other similar attractions.

نکاح

تعریف ضابطه مند نکاح عبارت است از : "وحدت یک مرد و یک زن برای زندگی با چشم پوشی از همه اشخاص دیگر ((1866) Hyde v. Hyde ).

در این مملکت ازدواج ، تک همسری است بدین معنی که همانطور که تعریف بالا نشان می دهد ، یک مرد و یک زن. جنسیت براساس تولد غیرقابل تغییر بوده و تاریخ تولد یک سابقه تاریخی محسوب میشود.

در دعوایR. v. registrar General of England and  Walse (1996)    دادگاه حکم داد که گواهی تولد ( از نظر جنسیت) برای شخصی که به منظور تغییر جنسیت عمل جراحی انجام داده است قابل تغییر نیست. هنگامی که یکی از طرفین مجاز به داشتن بیش از یک شریک (زندگی) در آن واحد باشد این (وضعیت)  چند همسری است. در برخی کشورها چند همسری مجاز است.

قبل از تحلیل بیشتر تعریف از باب مجموع تکالیف و تعهدات قانونی که نکاح بر طرفین بار میکند، مفید است که نتایج قانونی مقدماتی را که منتهی به ازدواج می شوند، نظیر نامزدی و با هم زیستن (بدون ازدواج) مد نظر قرار دهیم.

1- نامزدی

امروزه (امکان طرح) دعوایی بابت "نقض قول (ازدواج)" وجود ندارد. تا زمانی که قانون اصلاحی (مقررات پراکنده) (مصوب) 1970 این حق را منتفی کرد، یک طرف (معمولا زن) می توانست در صورتیکه طرف دیگر از نکاح امتنان کند بابت خسارت حاصله از نقض قرارداد (دایر بر توافق به انجام ازدواج) طرح دعوا نماید.

نامزدی ها معمولا واجد شکل (مشخص) شده ای است که عبارت است از دادن یک حلقه نامزدی توسط مرد به زن. هرگاه نامزدی به هم بخورد، این حلقه همچنان متعلق به زن می ماند مگر اینکه در زمان دادن آن مرد روشن کرده باشد که در صورت عدم تحقق ازدواج، حلقه باید مسترد شود. در دعوای Mossop v. Mossop (1988)  که دو نامزد به مدت 5 سال با هم زندگی کرده اما هیچگاه ازدواج نکرده بودند حکم داده شد که زوج های نامزد (و ازدواج نکرده) دارای همان حقوق زوج های مزدوج نیستند تا براساس مقررات وضع شده برای زوج های مزدوج، طرح دعوا کنند.

2- با هم زیستن

وضعیت  حقوقی زوجین غیر مزدوجی که با هم به صورت زوج و زوجه زندگی می کنند بسیار پیچیده است چرا که قانون چنین ازدواجی را به رسمیت نمی شناسد. با این وجود پارلمان به رسمیت شناخته که در موضوعات خاصی، این شرکای زندگی همان وظایف و مسایل شرکای ازدواج کرده قانونی را دارند و قانون گزاری مناسب (این امر را) صورت داده است.

به عنوان مثال، زن می تواند علیه ماترک شریک زندگی متوفایش به عنوان ذینفع طرح دعوا کند.

 

استلزامات نکاح معتبر

1-  هر دو طرف باید 16 ساله یا بیشتر باشند.

چنانچه یکی از طرفین زیر 18 سال باشد، هردوی والدین، در ضورت زنده بودن باید رضایت دهند. اگر والدین از دادن اجازه امتناع کنند  صغیر می تواند به دادگاه صلح مراجعه کند که در آن قضاوت صلح بر مبنای اینکه چه چیزی را در راستای حداکثر نفع صغیر قلمداد می کنند تصمیم می گیرند. نکاحی که از لحاظ شکلی بدون این اجازه صورت یافته باشد معتبر خواهد بود. نکاحی که یکی از طرفین آن زیر 16 سال باشد باطل است.

2-  درجات ممنوعه

طرفین نباید دارای نسبت خویشاوندی نزدیک باشند چراکه نکاح بین طرفینی که داخل در درجات ممنوعه هستند مجاز نیست. این بدان معنی است که اشخاصی که دارای نسبت نزدیک هستند خواه نسبی خواه سببی، نمی توانند با هم ازدواج کنند. واضح ترین خویشاوندانی که مجاز به ازدواج نیستند ، والدین هستند نسبت به فرزندان (مثلا پدر و دختر ، مادر و پسر) و برادرها و خواهرها ، قانون نکاح (مصوب) 1949 به نحوی که توسط قانون (تجویز) نکاح (مصوب) 1960 اصلاح شده است دو فهرست کامل درجات ممنوعه را عرضه می دارد. یک فهرستی حاکی از خویشاوندانی که زن نمی تواند با آنها ازدواج کند و فهرستی از خویشاوندانی که مرد نمی تواند با آنها ازدواج کند. به طور کلی عموها / دایی ها و عمه ها / خاله ها نمی توانند با برادرزاده ها / خواهرزاده های خود ازدواج کنند اما عموزاده ها می توانند با هم ازدواج کنند و زن می تواند درصورتیکه ازدواج با مرگ یا طلاق خاتمه یافته باشد یا برادر، عمو / دایی یا برادرزاده و خواهرزاده شوهرش ازدواج کند. مرد نیز حق مشابهی در ازدواج با خواهر ، برادرزاده ، خواهرزاده یا عمه / خاله همسر سابق خود دارد.قانون نکاح (درجات خویشاوندی ممنوعه) {مصوب} 1986 ، مقررات مضاعفی برای ازدواج اشخاص خویشاوند از طریق سبب (یا ازدواج) وضع می نماید.

به عنوان مثال ، امروزه مرد می تواند با زنی که دختر همسر سابق اوست و (البته دختر خود او نیست) ازدواج کند به شرط اینکه هردوی آنها 21 ساله یا بیشتر باشند و طرف جوان تر نبوده باشد { و در منزل آن مرد زندگی نکرده باشد}.

دلیل این ممنوعیت ها اولاٌ نظم عمومی و ثانیاٌ خطر ژنتیکی است که ممکن است موجب آثار جانبی نامطلوب یا شخصیتی در یک بچه متولد از ازدواج بین منسوبین خونی شود.

3-  هیچکدام نباید در قید ازدواج باشند

شخصی که برای دومین بار ازدواج می کند. در حالیکه ازدواج اول باقی است، ممکن است مرتکب جرم چند همسری شده باشد هرچند دفاع های زیر قابل طرح است:

الف) اینکه با حسن نیت و براساس مبانی معقول این باور که همسر مرده است وجود داشته ؛

ب) اینکه با حسن نیت و براساس مبانی معقول این باور که ازدواج اول باطل یا منحل شده وجود داشته ؛

ج) اینکه همسر اول مداوما برای هفت سال غایب بوده و هیچ دلیلی برای زنده فرض کردن شریک زندگی وجود نداشته است.

4- شرایط شکلی قرر شده توسط قانون

مراسم ازدواج باید انجام و با تشریفات به نحوی که توسط قوانین ازدواج {مصوب} 1949 و 1983 مقرر شده اجرا گردد.

ازدواج های باطل و قابل ابطال

ازدواج باطل بدین معنی است که تا جایی که به حقوق مربوط می شود، هیچ ازدواجی به وجود نیامده و طرفین در وضعیت تجرد به سر می برند. از طرف دیگر، ازدواج قابل ابطال تا زمانی که دادگاه صالح آن را باطل اعلام کند، معتبر تلقی می گردد. {برخی} ازدواج ها بخاطر نقصی باطل هستند که چندان اساسی است که نکاح را در حکم این می سازد که هیچگاه موجود نبوده است.

ازدواج های قابل ابطال، معتبرند اما بخاطر برخی اوضاع و احوال متعاقب یا {موجود} در زمان ازدواج ممکن است توسط دادگاهها باطل گردند.

1-  نکاح های باطل

قانون بطلان ازدواج {مصوب} 1971 به نحوی که اکنون در قانون اسباب نکاح { مصوب } 1973 ادغام گردیده است مقرر میدارد که نکاح {در موارد زیر} بواسطه آنکه ازدواج معتبری صورت نگرفته باید باطل گردد زیرا :

الف) یک یا هردو طرفین؛

اول) زیر 16 سال بوده اند.

دوم) جزء درجات ممنوعه بوده اند.

سوم) قبلا ازدواج کرده بودند.

چهارم) {با این ازدواج} وارد ازدواج چند همسری شده اند درحالیکه در انگلستان یا ولز مقیم بوده اند.

ب) نقص اساسی در مراسم عروسی وجود داشته؛

ج) {یکی از} طرفین بر حسب مورد ، مرد یا زن نبوده است.

 

2- ازدواج های باطل

ماده 2 قانون بطلان ازدواج {مصوب} 1971 به نحوی که در قانون اسباب نکاح {مصوب} 1973 ادغام شده مقرر می دارد که ازدواج ها به دلایل زیر قابل ابطال هستند:

الف)د ازدواج بدلیل عدم توانایی یا اتناع ارادی یکی از طرفین از نزدیکی ، منتهی به وصال نشده است.

این بدین معنی است که یک طرف قادر به داشتن رابطه جنسی نبوده است یا از آن اتناع کرده است.

ب) یکی از طرفین بواسطه اکراه، اشتباه، عدم سلامت روحی یا غیر آن به صورت معتبر به نکاح راضی نبوده است. طرفین نکاح باید رضایت خود را آزادانه اعلام کنند. به همین ترتیب، شخص مجنون نمی تواند رضایت معتبری ابراز دارد. زیرا نتایج آنچه را می گوید نمی داند. این وضعیت در موردی نیز ممکن است وجود داشته باشد که یکی از طرفین مست یا تحت تاثیر داروها{ی روان گردان} باشد.

ج) در زمان نکاح یکی از طرفین مبتلا به روانپریشی در حدود قانون سلامت روانی {مصوب} 1983 بوده که وی را برای ازدواج نامناسب می کند.

د) یک طرف مبتلا به بیماری مقاربتی مسری بوده و طرف مقابل نمی دانسته است.

ه) در زمان ازدواج، مرد نمی دانسته که عروس از شخص دیگری غیر از او باردار است.

دادخواست بطلان ازدواج می تواند فوراٌ به دادگاه داده شود. لازم نیست همانند طلاق، مدت زمانی منتظر ماند. دادخواست های مبتنی بر {بندهای} ج، د و ه فوق، باید ظرف سه سال تقدیم شده باشد اما در صورتی که خواهان مبتلا به ناراحتی روانی بوده است {این مدت} می تواند توسعه یابد. دادگاه اختیار دارد که از صدور حکم {موضوع خواسته} در صورتی که غیر منصفانه باشد خودداری نماید.

باید خاطرنشان کرد که اطفال متولد از

نکاح قابل ابطال، مشروع هستند حتی اگر ازدواج بعدا توسط دادگاه باطل اعلام شود و اطفال متولد از نکاح باطل در صورتی که در زمان لقاح (یا ازدواج – اگر متعاقباٌ {صورت گرفته باشد}) طرفین به صورت معقولی بر این باور باشند که ازدواج معتبر است، مشروع هستند.

شرایط شکلی نکاح

نکاح می تواند با تشریفات کامل توسط مراسم کلیسای انگلستان، مراسم مذهب دیگر یا در محاضر ثبت انجام شود. شرایط شکلی هریک از مراسم {مذکور} متفاوت است.

1-  کلیسای انگلستان

الف) اعلامیه ازدواج باید منتشر شود. اعلامیه ازدواج، یک آگهی عمومی است دایر بر اینکه این ازدواج قرار است صورت گیرد و باید سه یکشنبه در کلیساهای هریک یا هردو طرف منتشر گردد.

ب) مجوز عمومی باید توسط یک اسقف برای انجام ازدواج در داخل حوزه مذهبی یکی از طرفینصادر شود، یا اسقف اعظم کانتربوری مجوز مخصوصی صادر کرده باشد که به طرفین اجازه ازدواج در هر مکانی را بدهد.

ج) مجوز سردفتر باید صادر شده باشد که کلیسا را مجاز به برگزاری تشریفات ازدواج کند.

د) ازدواج باید بین ساعات 8 صبح تا 6 عصر ظرف 3 ماه از انتشار اعلامیه ازدواج صورت گیرد و باید دو شاهد یا بیشتر حضور داشته باشند.

2- ازدواج هایی که با مجوز سردفتر به صورت کامل انجام می شود

این مجوز اجازه می دهد که ازدواج صورت گیرد:

الف) در دفتر سردفتر ، یا

ب) در یک ساختمان جاز (معمولا یک مکان مذهبی از مذاهب غیر انگلیسی) به جز در ازدواج های بین دو یهودی ملتزم به دین یا بین اعضای جامعه دوستان (اعضای فرقه کوئیکر پروتستان)؛

ج) بین ساعات 8 صبح و 6 عصر، با درهای باز و نزد شهودی که حداقل دو نفر باشند بجز در مورد ازدواج یهودیان یا کوئیکرها؛

د) ظرف سه ماه از صدور مجوز؛

ه) قانون ازدواج {مصوب} 1983 ممکن می سازد که ازدواج اشخاص خانه نشین {مثلا به علت بیماری و ...} و تحت بازداشت، در مکانی که ساکن هستند، صورت پذیرد.

3- قانون نکاح 1994 واقع شدن نکاح های شهروندی را در "اماکن مجاز" ممکن می سازد.

اماکن توسط مقامات محلی به تصویب رسیده و باید دارای مقرراتی برای حضور عموم باشند. نکاح باید دارای دو شاهد، سردفتر و مامور اداره ثبتی که مکان در حوزه آن واقع است باشد. از خدمات مذهبی نمی توان استفاده کرد.

هدف این قانون که در 1 آوریل 1995 به اجرا در آمد، حفظ حرمت ازدواج است و مراسم می تواند در یک ساختمان ثابت در یک روند واجد شأن در یک اتاق مشخص یا محوطه مکان مجاز از نظر مقام محلی انجام شود.

این تغییر موجب درخواست های زیادی از سوی "ساختمان های" متعددی شده است، من جمله باشگاه های فوتبال، عمارت سلطنتی در برایتون، برج بلک پول و سایر جاهای جذاب.
